The words “You”, “Your(s)” or “Client” mean or refer to the person(s) booking and the venues management and staff.
The word “Venue” means the place at which the performance occurs and may be a building, marquee tent, teepee tent, hall or other construction used for the purpose of the performance.
The word “Guest(s)” means or refer to members of the public at the venue whether present through admission (i.e. ticket or fee) or who have been invited to the “Venue” and the “Event” by the “Client”. Also refers to other performing artists booked by the venue.
The words “We”, “Us”, “Our”, “Artist(s)”, “Performer(s)”and “Band” mean or refer to all members of the Mementos Band, Mementos Trio and Mementos Duo or any road, sound, stage or lighting crew accompanying the band.
The words “Our Equipment” mean or refer to all electrical equipment and mechanical devices, cases, musical instruments, cables, microphones, amplifiers, speakers, stage lighting, DJ and disco equipment, laptops, stands and accessories owned or hired by the performers, used in the live performance.
The word “Event” mean or refers to the period of time at the venue, including arrival time, unloading the equipment from our transportation vehicles, setting up, sound check, performance, intervals, packing down the equipment and loading the equipment in the transportation vehicles.
Deposits & Fee:
For private performances we require a proportion of the agreed fee in advance, currently 20%-50% depending on the nature or the overall value of the event. Your booking deposit is non-refundable and once paid will secure the performance date as discussed and agreed. Your deposit will then be deducted from the final fee. The deposit payment is due within 7 days of receiving the booking contract. The deposit is to be paid to the artist via BACS bank transfer (upon receiving the booking contract). The balance (remaining fee owed) is due to the artist 31 days before the event via BACS bank transfer.
Cancellation by the Client:
If you book us and subsequently cancel, you owe us the agreed fee or part thereof as shown below:
• Where cancellation is made within 7 days of receiving the signed booking contract, no cancellation fee is applicable.
• Where cancellation is made after 7 days of receiving the signed booking contract 25% of the booking fee is applicable.
• Where cancellation occurs within 90 days of the event 50% of the booking fee is applicable.
• Where cancellation occurs within 60 days of the event 75% of the booking fee is applicable.
• Where cancellation occurs within 31 days of the event 100% of the booking fee is applicable.
• If you ask us to stop performing at any point during the performance 100% of the booking fee is applicable.
Cancellation must be requested in writing via email to firstname.lastname@example.org only we can confirm cancellation of your booking which we will provide via email.
Cancellation by the Performer(s):
We reserve the right to cancel for any reason, though normally that will only occur because of circumstances beyond our control (e.g. illness, incapacity, breakdown of equipment or transportation or extreme weather conditions). In the unforeseeable circumstance of us having to cancel an event we will issue a refund of the initial deposit paid and any further payments received into our bank by the client. You agree that, if we cancel, we will not be liable for any cancellation fee or your losses. If this occurs, we will give you as much notice as possible and will try to help you find a substitute band if you wish.
Delay, Interruption or Suspension of Performance:
In the unlikely event that the performance is delayed, shortened due to events beyond our control, including but not limited to, equipment failure, power failure, noise/sound limiters, time restrictions, venues staff absence, smoke detector activation, closure of the venue by police, fire brigade or any other public authority or, licensing/certification problems, you agree to pay the agreed fee in full.
The client must respect that the equipment supplied by the artist(s) is expensive, fragile and is necessary for their livelihood. The client will be responsible for any stolen, or damage of equipment caused by the venue or a guest(s) of their party, and would incur the cost of full repair or replacement.
Access to Venue & Performance Area Requirements:
We require 90 minutes to set up and sound check prior to our performance and at least 60 minutes to pack down after the performance. You agree to inform us if the performance space is not allocated on the ground floor or if special access is required to allow us a longer set up / break down period for our equipment. Discovery of venue access complications, such as non-ground level located performance areas or restricted access times, following the confirmation of your booking may result in additional fees being charged. We also require no less than 4 x 4.5 meters of performance space and will require easy access to electricity supply of 3 x separate 13 Amp sockets.
Performance, Arrival & Departure Times:
All bookings made by private individuals assume the band to be onsite between the hours of 6pm and 1am with live performances and recorded music to be completed by midnight, or with a very close proximity to midnight (depending on the type event). Early arrivals (before 6pm) and late finishes (post midnight), require prior arrangement and maybe subject to additional fees beyond that of our standard quotation. It is your responsibility to advise upfront, and in good time, of any early or later operational hours. To help prevent any additional, late finishing fees, the performer(s) will begin to pack down their equipment once the last song has been performed live, without causing interruption, during the last hour(s) of recorded music being played by us or any other subcontracted entertainer or DJ.
Duration of Performance:
Unless otherwise agreed in advance, our performance shall normally consist of two sets of 60 minutes or three sets of 40 minutes in duration, separated by a 30-45 minute interval. Where you require additional performance time not previously agreed, this shall be at our sole discretion and shall be chargeable at a rate to be agreed at the time.
Food, Drink & Hospitality:
When booked to play an event we are normally away from home for more than 7 hours, the majority of which might be spent at your venue/event. With this in mind, we ask that you please provide a meal, soft drinks and water to all members of the band either immediately after we have set up and sound checked all our equipment or during our interval.
